Quick Answer: Can I Get Mexican Citizenship Through Grandparents?

Yes, since the reform to Article 30 of the Mexican Constitution on March 17, 2021, a person born abroad to a Mexican mother or father is Mexican by birth, regardless of where that parent was born.

If your grandparent was born in Mexico, your American parents can first be recognized as Mexican, and then you can be recognized through your parents. The process requires proving the family chain with official certified vital records.

How the Family Chain Works: Grandparent to Parent to You

If your grandparent was a Mexican national, the first question is whether we can establish the chain of Mexican nationality from your grandparent to your parents and then from your parents to you.

For example: Your grandmother was born in Michoacán, Mexico. Your mother was born in California, and you were born in California. First, your mother needs to acquire her Mexican nationality documented through her Mexican parent.

Once your mother's Mexican registration is done and her Mexican birth record is issued, your case can proceed through your mother.

In other words:

  1. Grandmother Born in Mexico

  2. Mother Born in U.S., establishes citizenship through her Mexican mother

  3. You Born in U.S., establish citizenship through your documented Mexican mother.

Why This Became Possible: The 2021 Reform to Article 30

In 2021, Mexican nationality law changed considerably, and many families still don't know about this meaningful impact.

Before this reform, only children of parents who were born in Mexico qualified for Mexican nationality by birth abroad. After the reform was modified, children of Mexican parents qualified even if their parents were born abroad.

For many Mexican American families, this change opened an important generational route. U.S.- born parents may now obtain Mexican nationality through their own Mexican parent.

Then that parent can become the link for the next generation, your generation.

That is why someone with a Mexican grandparent possibly has a path to be recognized as Mexican by birth, even when both the parent and grandchild were born in America.

Mexico has permitted dual nationality since 1998, and under U.S. law, recognition of another citizenship by descent does not lead to loss of U.S. citizenship.


Do I Get Mexican Citizenship Directly From My Grandparent?

No, the process does not skip the parent generation, even if your parent has no interest in Mexican documents. This is one of the most important things to understand since many families find incorrect information online.

Here's how it is: Your grandfather was born in Mexico. Your father was born in the United States and never obtained Mexican documentation. You were also born in the United States. We first address your father's Mexican citizenship and registration through your grandfather.

After your father's Mexican process is completed, we will address your Mexican citizenship through your now-registered father.

What Documents Are Needed? Complete 3-Generation Checklist

Every case is different, but a citizenship through grandparent(s) case starts by establishing the chain between all three generations through birth certificates. We review what you have and identify what is missing.

To apply through your Mexican Grandparent, we need the following documentation:

How Much Does It Cost?

We believe in transparent pricing after a free case review, not in hidden costs like other traditional law firms.

What we call a “Perfect Case” costs $400 USD. A perfect case is when all names, dates, and places match perfectly across generations of documents.

When there are discrepancies or name mismatches, we have what we call a “non-perfect case”; it costs $700 USD and is for cases where we need to correct names or date errors in the Registro Civil.

Can Multiple Family Members Apply Together?

Yes, and this is a great way to approach a multi-generation case.

Suppose one Mexican grandmother has three U.S.-born children and those children have four U.S.-born children of their own.

What If the Names Don't Match Across Documents?

This is the number one reason that applications get rejected. If your grandmother was registered as María Guadalupe Fernández Gómez in Mexico, but your mother's U.S. birth certificate says Ma. Guadalupe Gómez, the Mexican authorities considered it a mismatch.

What If the Mexican Birth Certificate Is Not Digitized?

Older birth certificates in Mexico are in physical, handwritten books in Civil Registry archives. If your grandparent's birth certificate does not appear in the official digital system, it doesn't mean it doesn't exist or that you have no case.

While their response time can sometimes feel a little slow, they are knowledgeable, straightforward, and, most importantly, they get the job done. Did I want to pay their fees? DNExpress is a professional and convent process for those that need a guiding hand in obtaining citizenship records. Please be advised that the company id normally working with several government agencies and grace must be given for the time that is needed. They worked diligently to find my grandfather birth records from the late 1800's in Mexico, then worked through protocols need for my father decided father Mexican citizenship. I cannot say enough great things about this company. They made everything so easy and were communicative every step of the way. Good things to know: - If their appointments are booked up, you can still email or message them on Whatsapp. I had been waiting for an available appointment for weeks and then saw someone on social media mention that they got in as a client via email. Reach out to them by either of those methods and they'll get back to you! - They can help with birth certificate amendments. My father’s name needed to be corrected on my California birth certificate to match his MX birth certificate exactly before I could move forward with dual citizenship. I was having trouble figuring out how to do this on my own so I asked DN Express if they could help and they did. They took care of that whole process. - Your parents marriage certificate is not needed even though it is listed as a required document on consulate websites if your parents are married. I tried to get dual citizenship myself first before finding DN Express, and the consulate representative told me I needed my parents marriage certificate (even though only 1 of my parents was born in Mexico). DN Express assured me it wasn’t needed, and they were right. - The whole process can be done without stepping foot in their office. They’ll work with you to make things as convenient as possible. The only time I met them in person was to pick up all my documents after the whole process was complete and I was already a dual citizen. They could have mailed all my documents to me, but since I am in the same city as their office, I opted to pick up. - They can help you with scheduling your INE and passport appointments at your local consulate. Getting appointments at the consulate can be difficult, so I was so thankful they could help with this part too! Highly recommend them!

Doble Nacionalidad Express was incredibly helpful in what ended up being a year long journey for my mom and I. My mom had a complicated case, with my grandmother having moved to multiple countries, meaning my mom wasn’t born in either the US or Mexico, and then my mom changed her name multiple times for marriage - but DNE was up for the challenge. When we ran into issues at a consulate visit, we called DNE immediately after, and from then on Adriana Martinez was on our case specifically. She was incredibly knowledgeable, helpful, and attentive, always answering all of our questions quickly and being available to make sure we knew what was going on with our process. Adriana helped us revise paperwork and got us additional documents just in case. Before our second try, we were able to have all of our questions answered by her over the phone and in person by her colleague in the Chula Vista office. My case, through my grandparents, was complicated. Their >100 year old Mexican birth records needed to be correctly digitized. My father’s US birth certificate needed to be officially amended by his US state. Once his DN was recognized and recorded in Mexico, mine came very soon after that.
